Terms and Conditions

PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT APPLY TO YOU.

This Agreement contains the terms and conditions that apply to customers for purchases from Cancos Tile. (hereinafter referred to as “Cancos Tile”) and the Cancos Tile entity named on the invoice that will be provided to you (ìCustomerî) on orders for products sold. Customer agrees to be bound by and accepts this Agreement as applicable to Customer’s purchase of product(s) from Cancos Tile, and/or the Cancos Tile Internet Website hereinafter named the “Site.” As a condition of sale, Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions apply (i) unless Customer has signed a separate formal purchase Agreement with Cancos Tile, in which case the separate Agreement shall govern; or (ii) unless other Cancos Tile standard terms apply to the transaction as noted herein or elsewhere. These terms and conditions are subject to change without prior written notice at any time, in Cancos Tileís sole discretion.

YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SALE IS INCLUDED IN YOUR ACCEPTANCE OF THE TERMS AND USE OF THIS WEBSITE.

1. GENERAL TERMS

• Inspection and Acceptance
  • It is the purchaser’s responsibility to inspect and sort all materials before installation. Installation constitutes acceptance of materials. No claims will be accepted after installation.
• Installation Recommendations
  • Use of leveling spacers for plank and rectangular tiles is recommended. Dry-laying tiles before installation ensures customer satisfaction.
• Material Defects
  • Cancos is not responsible for defects in color, shade, or materials after installation unless deemed defective by a Cancos representative.
• Shade Variations
  • Shade variations are inherent in ceramic tiles, natural stone, and grout. Actual tiles may differ from showroom samples. Ensure satisfaction before installation.

2. TILE QUANTITY RECOMMENDATIONS

• Confirming Quantities
  • Confirm required quantities with your tile installer or contractor. Cancos is not liable for incorrect orders.
• Quantity Estimates
  • Cancos provides estimated quantities as a courtesy for planning. Tiles are typically sold in full-carton quantities.
• Waste Calculation & Extra Material
  • Standard tiles: Order 10-20% extra.
  • Large-format tiles: Order at least 30% extra.
• Importance of Ordering Extra Material
  • Order extra material with your initial purchase to avoid mismatched shades or product availability issues.
• Special Orders
  • Special orders, including vanities, must be picked up within 5 days. Cancellations can only occur within 24 hours of purchase. No returns or exchanges after 24 hours.
• Shipping Discrepancies
  • Notify Cancos within 24 hours of shipping discrepancies.
• Delinquent Accounts
  • If your account becomes delinquent, you are responsible for any attorney’s fees incurred during collection efforts.
• Manufacturer’s Label
  • Product lines may have different marketing names depending on the manufacturer.

3. RETURN POLICY

• Return Location and Hours
  • Returns are accepted at our main warehouses (Farmingville, Hicksville, North Brunswick) during warehouse hours: Monday to Saturday, 9:00 AM – 4:00 PM.
• Return Requirements
  • Returns must be within 30 days of purchase with a sales receipt. Materials must be returned in full, in original packaging (cartons), and undamaged.
• Restocking and Handling Fees
  • Wholesale returns: 20% restocking fee.
  • Retail returns: 10% handling fee.
  • Customer pays shipping fees unless otherwise specified.
• Refunds
  • Refunds will be processed to the original form of payment. Cash refunds over $50 will be issued by check, with a 14-day processing time.

4. NON-REFUNDABLE/NON-EXCHANGE ITEMS

• Items Not Eligible for Refund/Exchange
  • Marble and Granite, Custom Fabrication, Grout, Calk, Setting Materials, Special Order Items, Final Sale Items, Natural Stone Slabs, Porcelain Slabs.

5. LIMITATION ON DAMAGES

• Liability
  • Cancos Tile & Stone is not liable for any consequential, special, or punitive damages. Liability is limited to the total amount paid for the purchase.

6. PRODUCT VARIATION

• Color and Size Variation
  • Products may have variations in color, shading, veining, or size. It is recommended to purchase samples for an accurate representation.

7. FREIGHT AND DELIVERY TERMS

• Freight & Handling Charges
  • Charges are non-refundable and will be added to sales orders or invoices.
• Estimation of Freight Charges
  • Freight charges are subject to change at the time of shipment.
• Re-delivery & Storage Fees
  • Re-delivery and storage fees apply if a scheduled delivery cannot be accepted.
• Changes to Delivery Address
  • Changes after shipment release may incur additional fees.
• FOB Shipping Point
  • Shipments are FOB shipping point unless otherwise specified.
• Claims for Incorrect or Damaged Materials
  • Claims for incorrect or damaged materials must be reported within 48 hours of delivery.
• Customer Pickup & Freight
  • Customer pickups are FOB at the point of pickup unless otherwise stated.
• Large Volume Factory-Direct Shipments
  • Large-volume orders are FOB shipping point.
• Payment & Delivery Scheduling
  • Delivery will be scheduled once agreements are signed and payment is received.

8. TAXES

• Customer Responsibility
  • The customer is responsible for any applicable taxes, duties, or clearance charges.

9. TITLE; RISK OF LOSS

• Title Transfer
  • Title passes upon completion of shipment. Cancos is responsible for loss or damage during shipping by a carrier selected by Cancos Tile.

10. FORCE MAJEURE

• Liability Limitations
  • Cancos Tile & Stone is not liable for delays due to circumstances beyond control, including natural disasters, strikes, or pandemics. Cancos reserves the right to cancel affected deliveries if the delay exceeds 45 days.

11. WARRANTIES

• Manufacturer’s Warranty
  • Cancos Tile & Stone offers no warranties beyond the manufacturer’s warranty. All other warranties are expressly waived.
